A Polish residence card application starts with the reason you intend to stay. Employment, running a business and living with family call for different evidence. Choosing the relevant procedure first helps you build a useful document checklist instead of paying for certificates or translations you may not need.
Check what currently makes your stay lawful
Identify your present basis: a visa, visa-free stay, a residence permit or a special status. Write down the end date of your lawful stay and the conditions attached to it. The expiry date printed on a plastic card, the duration of a permit and your permitted period of stay should not automatically be treated as identical.
This guide mainly concerns nationals of countries outside the EU. EU, EEA and Swiss citizens follow different procedures. If you hold temporary protection or another special status, check the rules for that status before choosing an ordinary residence application.
Match the application to your actual circumstances
- Employment with a Polish employer: check eligibility for a temporary residence and work permit, your contract terms and the employer’s role in preparing the application.
- Business: assess your real activity and financial evidence. Registering a company does not by itself create a right to reside.
- Family: both your relationship and the status of the person you are joining matter.
- Studies: the course, institution and conditions of the relevant permit need checking.
Permanent residence and EU long-term resident status have their own eligibility rules. Wanting a longer-lasting card is not enough to qualify. The main categories appear in the Foreigners Act.
Separate personal documents from evidence of your purpose
For an initial review, prepare information about your citizenship, current status, relevant dates, city of residence and planned basis. If a case is already pending, locate the filing acknowledgment and the latest letters from the voivodeship office.
This makes it easier to spot what is missing: an employer’s annex, a family certificate or financial records. There is no single translation package that suits every procedure. Check the particular documents before ordering work on them.
Plan for filing through MOS
Since April 27, 2026, the main applications for temporary residence, permanent residence and EU long-term resident status have been filed through the new MOS system. Exceptions apply, including certain family procedures concerning people outside Poland. The new process was introduced by the Act of November 21, 2025.
Work out who must prepare any required annex and which signatures are needed. Our residence card documents and MOS guide explains the filing steps.
Keep track of the case after submission
Save the application, attachments and acknowledgment. Monitor official correspondence and the deadlines in any request. Timely filing preserves lawful stay only when the statutory conditions are met. Saving a draft is not a submission.
Permission to work must be checked separately from lawful residence. A filing acknowledgment also does not replace a document needed to cross the border.
