Registering a business and obtaining the right to live in Poland are separate matters. A business-based residence card application needs evidence of the purpose of your stay and the relevant permit conditions. An entry in CEIDG or KRS confirms registration but does not replace the remaining evidence.
When is the business route relevant?
This route is considered when genuine business activity justifies a stay exceeding three months. The legal structure and your role matter. The rules can cover entrepreneurs and, in specified circumstances, shareholders performing management functions. Merely owning shares does not automatically create a right to a residence card.
First check your eligibility to use the chosen business structure and the appropriate residence basis. Not every foreign national can operate every legal form on the same terms.
What economic conditions are assessed?
Article 142 of the Foreigners Act provides alternative ways to demonstrate the business’s economic position. In the ordinary procedure, one of the following routes is assessed.
- Income in the tax year before filing: at least 12 times the average monthly gross wage in the relevant voivodeship for the preceding year, as announced by GUS.
- Employment of at least two workers from the statutory categories: full-time, under indefinite contracts, for at least a year before filing.
- Funds or activities enabling those conditions to be met in the future, such as investment, technology transfer or job creation.
The test concerns income (dochód), not simply turnover or revenue (przychód). A single amount cannot be used for all of Poland without checking the region and year. Nor do any two employees automatically satisfy the employment route.
What if the business is new?
A promise of future sales does not replace evidence. Available funding, signed contracts, investments, purchases, hiring plans and credible calculations can help substantiate future performance.
A business plan is useful when its assumptions are supported by documents. An attractive forecast alone does not guarantee a permit. The applicant’s personal conditions are checked separately, including insurance, maintenance resources and accommodation to the extent required.
Documents to organize
- CEIDG or KRS details and evidence of your role in the company.
- Tax returns and financial statements with filing confirmations where already required for the business.
- Contracts, invoices and bank records supporting genuine trading activity.
- Employment and ZUS records when relying on the staffing route.
- Funding and development evidence when relying on future performance.
This is not a universal package for every firm. Personal maintenance funds and company results need to be distinguished where they concern different legal persons. A voivodeship office publishes an overview of the business residence procedure.
Make the application consistent with the accounts
Compare the figures in your application, tax records and development plan. Explain differences between reporting periods and check signatures and translations. Our residence card and MOS guide covers the electronic filing stages.
Pobyto can discuss residence card support for business owners and identify the evidence relevant to your situation. Agree the scope and cost of assistance before starting work.
Checked on October 19, 2026. Assessment depends on the business structure, the applicant’s role and the evidence presented.
