Employer has not signed the MOS annex: what can you do?

A practical checklist for a delayed employer annex: HR contact, authorised signer, electronic signature and confirmation that your application was sent.

If your selected application requires an employer annex, MOS will not let you complete submission without it. A saved draft is not a filed application. Start by identifying the reason for delay: an undelivered email, unresolved information, an unavailable authorised signer or a company refusing to participate.

What the employer needs to do

When preparing the relevant application, you enter the employer’s email address. The system sends a link to complete and sign the appropriate annex. For an ordinary temporary residence and work application, this is Annex 1. Your signature on the application and the employer’s signature on the annex are separate actions.

The UdSC MOS explanation states that a required annex must be signed electronically; scanning a handwritten signature does not replace that step. The employer link remains valid for 30 days. If it expires, check the current interface or official support for obtaining another link rather than assuming the old one still works.

Find the precise obstacle

Do not ask anyone to sign information that differs from the actual employment arrangements. If an agency is involved, also check the user employer’s details. Compare “we have sent everything” from HR with the state of your own application in MOS.

A useful message to HR

For example: “My residence application requires an electronic Annex 1. The link was sent to the agreed email address. Please confirm who checks the information, who signs on behalf of the company and when the annex will be completed.”

This is an organisational example, not a formal legal demand. Keep passwords, login codes and unnecessary personal document copies out of shared email threads. The company completes its part while you retain control over your own login and application signature.

If lawful stay is about to end

Immediately compare the expiry date, preparation stage and genuinely available application basis. An employer delay is not automatically an officially confirmed outage of the government portal. Special rules for MOS unavailability cannot simply be applied to a missing company signature.

If the employer refuses outright, assess whether another lawful basis or solution fits the actual circumstances. Do not enter false information or replace an ordinary electronic application with paper solely to obtain a posting date. An approaching deadline calls for an individual legal assessment rather than waiting indefinitely for HR.

Confirm that the application was sent

An email saying the application is ready to submit does not submit it for you. After receiving the required annex, review the remaining fields, sign and send your application, then save UPO. Our residence card and MOS guide describes the sequence.
