To open a Polish sole proprietorship, first check your eligibility. Prepare the business name, addresses, PKD 2025 codes, starting date and tax choice. Submit a signed CEIDG application, activate e-Doręczenia and complete ZUS and tax requirements. Registration is free; running the business needs a separate budget.

Short answer

To open a Polish sole proprietorship, first check your eligibility. Prepare the business name, addresses, PKD 2025 codes, starting date and tax choice. Submit a signed CEIDG application, activate e-Doręczenia and complete ZUS and tax requirements. Registration is free; running the business needs a separate budget.

Step 1. Check your right to operate a JDG

Nationality and the precise residence basis matter more than having a PESEL number. Not every temporary residence card or labor-market-access endorsement permits self-employment. Use the JDG eligibility check and guide for foreign nationals. Being allowed to own company shares does not automatically qualify you for JDG.

The official Biznes.gov.pl guide is a starting point. A Ukrainian national starting a new business should not assume that the former formula of lawful stay plus any PESEL number remains sufficient. Verify a current qualifying special status or another independent residence basis.

Step 2. Prepare the application details

DetailWhat to establish
Your first and last names in the business nameRequired naming element; a brand can be added
Addresses and entitlement to use the propertyAn accurate entry; a separate office is not always required
Main and additional PKD 2025 codesActivities you actually plan to carry out
Starting dateInsurance and practical obligations
Tax choice and bookkeeping methodPIT, contributions and reporting

New registrations use PKD 2025. A code does not replace a license, permit or professional qualification. Choose tax treatment with an accountant using your activity and calculations; a PKD code alone does not automatically determine a revenue-tax rate.

Step 3. Submit and sign the CEIDG application

The official CEIDG procedure describes registration and signing. An online application requires an accepted signing method; a saved draft does not register the business. If NIP and REGON identifiers have not been assigned, the application initiates their assignment and they are subsequently added to the entry.

From 1 November 2026, a new CEIDG registration application must be electronic, except applications naming a statutory representative, which follow a separate procedure. From that date, a foreign national must have PESEL or, if none has been assigned, the prescribed unique identifier issued by an EU member state for cross-border identification. This is an enacted change in Journal of Laws 2026 item 507, not a proposal. The act has several commencement dates; 1 November is the relevant date for this rule.

Step 4. Activate electronic official delivery

Prepare the details for an electronic delivery address, ADE, when registering. If you choose the public e-Doręczenia service, activate the mailbox after creation. Ordinary email is not a substitute. Monitor correspondence because official delivery has legal consequences. Biznes.gov.pl explains the requirements.

Step 5. Complete post-registration requirements

Check your CEIDG entry and identifiers. Registration as a ZUS contribution payer does not replace insurance enrollment. The official instructions require insurance registration within seven days of commencing activity using the appropriate ZUS ZUA or ZZA form. In the cases provided for, these documents can accompany CEIDG registration.

With an accountant, check relief eligibility, health insurance, VAT-R where required, records and whether KSeF applies. Regulated activities require their industry conditions to be met before the relevant services start. A registry entry does not remove those duties. Review our JDG and ZUS budget guide.

Gdańsk and other Polish cities

CEIDG is a national register. Choosing Gdańsk, Warsaw or Wrocław does not itself change a foreign national’s eligibility. Addresses, local arrangements and industry requirements can differ. A virtual address does not create a right to self-employment.

Frequently asked questions

What does registration cost?

The CEIDG entry is free. Bookkeeping, translations and any assistance you choose are separate costs.

Do I need a separate office?

Not for every activity. Listed addresses must be accurate and property use lawful.

Who is responsible for the business debts?

The entrepreneur is an individual, not a separate company. Compare JDG and sp. z o.o. before choosing.

Pobyto offers JDG registration assistance. Agree the scope and price before work begins. If your residence basis is unclear, start with a consultation.

Who can open a sole proprietorship in Poland in 2026?

Not every foreign national can open a JDG in Poland. Eligibility depends on citizenship and the specific residence basis; a PESEL number or labour-market access annotation alone is not enough. Check your status and residence decision before choosing the business structure and tax treatment.
