Polish business residence permit: company income, employees and a new business

A business-based Polish residence permit considers the company's previous tax-year income, qualifying employment or evidence of meeting those conditions in the future. The income benchmark is 12 average gross monthly wages for the relevant voivodeship in the preceding year. A registered company, high turnover or PLN 5,000 capital does not by itself secure a permit.

Financial documents and rising columns illustrating business income and development for residence

Short answer

A business-based Polish residence permit considers the company's previous tax-year income, qualifying employment or evidence of meeting those conditions in the future. The income benchmark is 12 average gross monthly wages for the relevant voivodeship in the preceding year. A registered company, high turnover or PLN 5,000 capital does not by itself secure a permit.

What the authority assesses

Article 142 of the Foreigners Act governs temporary residence for business activity. Alongside the business condition, the applicant demonstrates health insurance, stable and regular income sufficient to support themselves and dependent family members, an assured place of residence and any required authorisation for a regulated profession or position.

Personal income and the business result are separate matters. A board member's remuneration may evidence personal maintenance, but it does not thereby become company income. Funds in a company account are not necessarily the shareholder's private money.

Three routes for the business condition

RouteWhat is assessedEvidence to prepare
IncomeBusiness income for the preceding tax year at least equal to the regional thresholdTax return, filing confirmation and accounting records
EmploymentAt least two workers in the statutory categories, full-time, indefinite contracts, for at least the year before applicationContracts, qualifying status, payroll and ZUS records
Future complianceFunds or genuine activity enabling the income or employment condition to be met in futureFunding, contracts, investment, confirmed orders and a substantiated plan

These are alternative ways of addressing the business condition. Every company is not required to have both high income and two employees. The other applicant requirements still apply. See the official Podlaskie regional guidance.

How to identify the income threshold

The statutory formula is 12 × the average gross monthly wage in the national economy in the voivodeship of the entity's registered office or place of residence, for the year preceding the application. The business income is assessed for the preceding tax year. This is not the national minimum wage, the average for the enterprise sector alone, or invoiced turnover.

First identify the application year, the business tax year and the relevant voivodeship. Ask your accountant to select the corresponding GUS announcement and compare the threshold with the tax return. If the required year's statistics have not yet been announced, ask the competent authority how to document the condition. Do not substitute an unrelated average.

A single figure advertised “for all of Poland” can therefore mislead. A business in Pomorskie, Mazowieckie or Dolnośląskie should not automatically use the same regional benchmark.

A new or loss-making company

A new business may have no complete preceding year. The Act allows evidence of funds or activity enabling future compliance. That is not an automatic exemption from the requirements or a guarantee of approval.

Build a verifiable chain: where funding comes from, which contracts have been signed, what has been purchased, what is needed to deliver orders and how this supports income or jobs. Sales projections are more useful when linked to contracts, capacity and payment dates. An optimistic business plan without supporting evidence provides a weaker basis for assessment.

Documents to discuss with your accountant

This is a preparation list rather than a universal final application pack. The Pomorskie authority publishes local business-residence requirements for Gdańsk. Check submission and response channels with your own regional authority.

A shareholder who also sits on the board

Your company role affects the procedure. Article 142 provides a business basis for a foreign national performing board functions in a sp. z o.o. they formed or in which they acquired or subscribed for shares. The word “director” in a contract does not determine the route. Assess the specific work rights, residence basis and company position together.

Frequently asked questions

Does PLN 200,000 turnover satisfy the condition?

Turnover is not income, and the threshold depends on year and region. A calculation using the accounts and the appropriate GUS benchmark is needed.

Can any two employees satisfy the employment route?

No. The statutory worker categories, full-time hours, indefinite contracts and required year of employment before application all matter.

Must a new company without an annual return be refused?

Not necessarily. Evidence of future compliance can be considered, but the authority assesses real funds, activities and all other circumstances.
